Dispute Resolution

 


Invoice disputes are a major contributor to production delays on-site. Non-payment of abnormal claims frequently leads to subcontractors refusing to fulfill new requests and can result in significant cash flow problems, preventing the purchase of materials or payment of operatives. In addition, there has been an increase in solicitor referrals for long-standing debt and "loss of profit" claims. Groundworks Tenders

 


Groundworks pose the most significant budget risk for the vast majority of development projects. Mitigating this risk during the tender stage is crucial. Factors such as pre-lims, spoil and topsoil management, retaining walls, and drawing errors and omissions present opportunities for cost overruns.


At GP Commercial Solutions, we have extensive experience with numerous groundworks tenders. Our expertise ensures that tender inclusions and exclusions are consistent and well-understood by all parties involved. We diligently identify and report areas of risk while making appropriate provisions to address them. Additionally, we have established relationships with the major groundworkers in the Midlands area and will directly engage with them to ensure robust and comprehensive tenders are produced.

Complex Developments

 


The complex nature of controlling budgets on larger developments and consortium sites is often under-estimated and consequently under-resourced leading to major 'cost busts'. The Commercial Management of consortium sites, mixed use developments (and the complex earthworks and remediation strategies that often come with them) present far more challenges than a standard greenfield development. Keeping control of these budgets, running risk and reward trackers and ensuring correct and timely re-charging of consortium developers will keep these risks controlled, monitored and understood by all.

The management of Section 106 (S106) costs and associated indexation is frequently neglected or inadequately reviewed, leading to significant cost overruns, particularly during periods of heightened inflation. Different indices may apply to various aspects of the same S106 agreement, making accurate tracking essential.
